Article 1 (Purpose and Operator)
- This Privacy Policy (the "Policy") describes how Miao Zhihao (trade name: Alpax) ("we," "us") handles information about users ("you") of the smartphone and tablet application "Neko Kingyo" (Japanese title: "猫金魚:ねこきんぎょを育てる癒しの水槽") (the "App").
- Our address will be provided without delay upon request to the contact in Article 16.
Article 2 (Basic Approach)
- The App does not ask for your name, address or phone number. When you first launch it, the App automatically creates an anonymous account that does not use an email address or the like. You may choose whether to use Sign in with Apple (Article 6).
- The App connects to the internet only for the following purposes:
- Saving and loading Game Records (neko kingyo, Gold Scales, care status, collection book, rankings and so on) (Article 6)
- Purchasing Neko Kingyo Premium (an auto-renewing subscription) and one-time products, and checking purchase status (Article 7)
- Showing ads (rewarded ads) that you choose to watch, and checking your consent regarding ads (Article 8)
- We do not run our own analytics in the App. Tracking for advertising is performed by Google only if you allow it on your device (Article 8).
- The App never shows ads automatically. Ads are shown only when you choose to watch one to receive Gold Scales.
Article 3 (Purposes of Use)
We use the information we obtain only for the following purposes:
- Providing the App, managing Game Records, and carrying them over after a device change or reinstall
- Calculating and displaying rankings
- Determining whether you can use Neko Kingyo Premium and one-time products, and restoring purchases
- Showing rewarded ads and confirming that you receive Gold Scales for watching them
- Preventing and investigating improper use (such as improperly obtaining Gold Scales)
- Handling ranking reports (such as reviewing and changing inappropriate nicknames)
- Responding to inquiries, and investigating and fixing problems in the App
- Important notices, such as changes to the Terms or this Policy
Article 4 (Information Stored Only on Your Device, and Device Features)
- The following information is stored only on your device for the App to work, and is never sent off the device. It is deleted when you delete the App.
- Background, tank appearance, light effects, volume, song, image quality, vibration and other app settings
- Progress through the first-time guide and records of notices you have seen
- The public IDs of users you have blocked in the rankings (Article 6, paragraph 2)
- Information for keeping you signed in to your account under Article 6 (a string indicating your sign-in state) is stored in your device's keychain.
- Only when you turn on "Sway with tilt" in Settings does the App read your device's accelerometer. These values are used only to draw the screen and are neither stored nor sent.
- Only when you record and save a video of your tank does the App ask for permission to add to your photo library. The App only adds videos to your photo library and does not read its contents. We never receive the videos you record. When you share an image of your ranking, the image is created on your device and passed only to the destination you choose.
- The App does not access your microphone, camera, location, contacts, calendar, Health data or any other such information.
Article 5 (Information We Do Not Collect)
We do not collect:
- Your name, address or phone number (even if Apple provides your name during Sign in with Apple, we do not store it)
- Your advertising identifier (IDFA) (except as obtained by Google if you allow it, under Article 8)
- Your location (except where Google estimates your approximate region for advertising, under Article 8)
- Records of your actions in the App (except the Game Records in Article 6 and the purchase records in Article 7)
Article 6 (Accounts and Game Records)
- To manage Game Records, the App sends the following information to, and stores it on, our server built on "Supabase," a service provided by Supabase, Inc. (data is stored in Japan (Tokyo)):
- Account identifier: a random string for each user, created by the server when you first launch the App (it is not your Apple ID or email address)
- If you use Sign in with Apple: the user identifier issued by Apple and the email address provided by Apple (if you choose "Hide My Email," the relay address created by Apple). These are used only to let you return to the same account after changing devices or the like. We also exchange the authorization code we receive from Apple at sign-in for a token issued by Apple and store it. This token is used only to ask Apple to revoke it when you delete your account, and cannot be read from the App
- Your nickname and the names of your neko kingyo
- The kind, personality, growth and affection of each neko kingyo, whether it is in the tank or the Rest Room, and when it was born
- Your Gold Scale balance and the history of changes to it (date, time and details of pickups, ad views, gacha draws, exchanges for food or treats, rewards and so on)
- Care records (hunger and cleanliness status, food stock, leftovers, times of feeding and cleaning), daily usage counts, gacha results, collection book and exchanged items
- Weekly ranking points and total level
- One-time products you have purchased and the expiry date of Premium (Article 7)
- Your device's time-zone offset, used to decide when each day begins
- If you report another user in the rankings: the account identifiers of the reporting and reported users (in the App, the other user is referred to by a public ID), the reported user's nickname at the time, the reason (offensive name, personal information, or other), and the date and time
- Connection logs (source IP address, date and time, type of request, etc.), recorded by the Supabase service for operating the server and preventing improper use
- In the rankings, your nickname, rank, points, and the kind and level of your most grown neko kingyo are shown to other users. Each row also includes a public ID (a string created from the account identifier that cannot be turned back into it) used as the target of reports and blocks. Your list of blocked users is stored only on your device and is not sent to us. If you do not want to appear in the rankings, please contact us at the address in Article 16.
- The same account identifier is also used to confirm purchases (Article 7) and ad views (Article 8).
Article 7 (Purchasing Neko Kingyo Premium and One-Time Products)
- The App uses "RevenueCat," a service provided by RevenueCat, Inc., to manage purchases of Neko Kingyo Premium and one-time products ("Remove Ads" and the limited breed "Yozora") and to check purchase status.
- The following is sent to RevenueCat: the account identifier in Article 6, your App Store purchase records (products purchased, purchase date, expiry date, auto-renewal status, etc.), your device and App version, and your country and currency settings. Your name, email address, Apple ID and advertising identifier (IDFA) are not sent.
- Right after a purchase and whenever your purchase status changes, our server receives your purchase status from RevenueCat and reflects it in the Game Records in Article 6.
- This information is used only to determine whether you can use Premium and products and to restore purchases. It is not used for advertising or tracking.
- RevenueCat handles information in accordance with its privacy policy (https://www.revenuecat.com/privacy).
Article 8 (Advertising)
- The App shows video ads (rewarded ads) from "Google AdMob," an ad service provided by Google LLC, only when you choose to watch one to receive Gold Scales. While you are subscribed to Neko Kingyo Premium, and after you purchase "Remove Ads," the ad entry point is not shown and Google's SDK is not started.
- Except in the cases above, so that an ad can be shown right away, the App starts Google's SDK at launch and loads an ad in advance (it only loads it; nothing is shown until you choose to watch).
- When loading and showing ads, Google may collect information such as device identifiers (including the advertising identifier (IDFA) if you allow it), IP address, records of ad impressions and interactions, approximate region, device type and performance, and OS version.
- You can choose whether to allow the advertising identifier (IDFA) to be used for advertising in the device prompt shown the first time you tap the ad entry point. The number of Gold Scales you receive is the same whether or not you allow it. You can change this at any time in Settings > Privacy & Security > Tracking on your device. While tracking is not allowed, non-personalized ads are shown.
- In regions where consent is required by law, such as the European Economic Area, the United Kingdom and Switzerland, a screen provided by Google (User Messaging Platform) lets you choose whether to consent to the use of information for advertising. You can change your choice at any time from "Ad privacy settings" in the App's Settings.
- When you watch an ad, the App passes the account identifier in Article 6 to Google. When you finish watching an ad, Google notifies our server directly, together with that identifier, and this is used to give you Gold Scales.
- Google handles information in accordance with its privacy policy (https://policies.google.com/privacy) and its explanation of advertising (https://policies.google.com/technologies/ads).
Article 9 (Information Sent Externally)
In accordance with Article 27-12 of the Telecommunications Business Act of Japan, we disclose the information sent from your device to external parties as follows.
- Recipient: our server (on Supabase, Inc.'s service)
- Information sent: the account identifier and Game Records in Article 6, the Apple identifier, email address and authorization code if you use Sign in with Apple, ranking reports, time-zone offset, IP address
- Purpose: managing and carrying over Game Records, rankings and handling reports, confirming purchases, deleting accounts, preventing improper use
- Recipient: RevenueCat, Inc. (RevenueCat SDK)
- Information sent: the account identifier in Article 6, App Store purchase records, device and App information, IP address
- Purpose: managing purchases of Neko Kingyo Premium and one-time products and checking purchase status
- Recipient: Google LLC (Google Mobile Ads SDK, User Messaging Platform)
- Information sent: device identifiers (including the IDFA if you allow it), the account identifier in Article 6, IP address, records of ad impressions and interactions, device and OS information, consent status
- Purpose: showing rewarded ads and measuring their effectiveness, confirming ad views, managing consent for ads, preventing improper use
- When sent: at App launch while you are not using Neko Kingyo Premium or "Remove Ads" (consent check and ad loading), and when you watch an ad
- Recipient: Apple Inc.
- Information sent: purchase procedures, Sign in with Apple procedures, crash reports if you agree to share them, etc.
- Purpose: processing purchases and sign-in, distributing and improving the App
Article 10 (Information Obtained Through Inquiries)
If you contact us by email, we use the email address and content you send only to respond to your inquiry. Please do not include personal information of others in your inquiry.
Article 11 (Provision to Third Parties and Outsourcing)
- We do not provide personal data to third parties without your consent, except where required by law, where necessary to protect a person's life, body or property, or as otherwise permitted under the Act on the Protection of Personal Information. Showing rankings under Article 6, paragraph 2 is a feature of the App that displays the nickname and other details you set in the App to other users.
- To the extent necessary to achieve the purposes of use, we outsource the handling of information to the following providers:
- Supabase, Inc. (server operation and information storage)
- RevenueCat, Inc. (purchase management)
- Google LLC (ad delivery; Google handles information under its own rules)
- If the App's business is succeeded to another party through business transfer, merger or other reasons, information may be transferred to the successor.
Article 12 (Storage and Handling Abroad)
- All of the providers above are U.S. companies. The Game Records in Article 6 are stored in Japan (Tokyo), but information may be handled in the United States or other countries to operate each company's services. Information held by RevenueCat and Google may be stored and processed on servers in the United States or other countries.
- The United States has no comprehensive federal privacy law; instead it has state laws (such as the California Consumer Privacy Act) and sector-specific laws. For information on each country's system, see the website of Japan's Personal Information Protection Commission (https://www.ppc.go.jp/personalinfo/legal/kaiseihogohou/#gaikoku).
- We confirm, through each company's terms of service, data processing agreements and the like, that our providers have systems in place to continuously take measures equivalent to those required under the Act on the Protection of Personal Information.
Article 13 (Security Measures)
To prevent leakage, loss or damage of the information we handle, we take the following measures:
- We have established a basic policy and handling rules, and limit those who handle information to ourselves
- Access to servers and admin screens is limited to our own accounts
- Communications are encrypted (HTTPS). The App can read only your own records, and records can be changed only through fixed processes on the server. Apple tokens and report records are stored where the App cannot read them
- Information whose retention period has passed is deleted (Article 14)
- For handling abroad, we understand the systems of the relevant countries and confirm our providers' measures, as described in the preceding Article
Article 14 (Retention and Deletion)
- Game Records under Article 6 are kept for as long as we continue to provide the App, or until you delete your account. If we end the App, they are deleted after a reasonable period.
- Inquiries under Article 10 are deleted appropriately after the period needed for responding and improvement has passed.
- Retention and deletion of purchase records under Article 7 and advertising information under Article 8 follow the rules of RevenueCat, Inc. and Google LLC respectively. Records of App Store purchases themselves are managed by Apple Inc.
Article 15 (Requests for Disclosure, Correction, Deletion, etc., and Account Deletion)
- You may request, by email to the contact in Article 16, notification of the purposes of use, disclosure (including records of provision to third parties), correction, addition or deletion, suspension of use or erasure, and suspension of provision to third parties of personal data about you that we hold.
- You can delete your account at any time from Settings > Account > Delete account in the App. When you do, all information we store on our server under Article 6 (including your account, neko kingyo, Gold Scales, care, ranking and report records, and your Apple token) is deleted, and the purchase management records stored at RevenueCat are also deleted. If you used Sign in with Apple, we ask Apple to revoke the stored token. After deletion, the App starts over with a new anonymous account.
- If you cannot use the method in the preceding paragraph, for example because you can no longer operate the App, please email the contact in Article 16 with the subject "Account deletion." To verify your identity, we will ask for details such as your nickname, the names and kinds of the neko kingyo in your tank, your approximate Gold Scale balance, approximately when you started using the App, and, if you use Sign in with Apple, the email address of that Apple ID (including a relay address). If we cannot verify your identity, we may be unable to respond to your request.
- We charge no fee for requests. We will respond by email within the period required by law. Where permitted by law, such as where we are not legally required to respond or where responding would seriously hinder the proper conduct of our business, we may decline all or part of a request and will tell you why.
- When you delete your account, all of your data is erased, and your neko kingyo, Gold Scales, exchanged items, and care and ranking records cannot be restored. Deleting your account does not stop auto-renewal of Neko Kingyo Premium, so please cancel it separately in the App Store (Settings > [your name] > Subscriptions on your device). One-time products can be received again by using "Restore purchases" with the same Apple Account.

Article 17 (Users in the European Economic Area, the United Kingdom and Switzerland)
- For users in the European Economic Area, the United Kingdom and Switzerland, we act as the controller under the EU General Data Protection Regulation (GDPR) and equivalent laws, and handle information on the following legal bases:
- Performance of a contract: managing Game Records, rankings, providing Neko Kingyo Premium and products, responding to inquiries (Articles 6, 7 and 10)
- Consent: personalized ads and the use of information for them (Article 8). You may withdraw consent at any time
- Legitimate interests: preventing improper use, operating servers securely, improving the App
- In addition to the requests in Article 15, these users may request data portability, restriction of processing, and object to processing based on legitimate interests, and may lodge a complaint with the supervisory authority of their country of residence.
- When information is transferred outside the European Economic Area and similar regions (including to Japan and the United States), we rely on the European Commission's adequacy decision for Japan, the European Commission's Standard Contractual Clauses adopted by our providers, or other appropriate safeguards.
Article 18 (Children)
- The App is not primarily directed at children under 13 (or a higher age where your country sets one). Children should use the App with the consent of a parent or guardian.
- The App is designed not to ask for information that identifies individuals, such as names. Please do not use a child's real name or the like as a nickname or as the name of a neko kingyo. If we learn that we have received personal information from a child under 13 without parental consent, we will delete it promptly.
Article 19 (Changes to This Policy)
- We may change this Policy in line with changes in laws, new App features and so on.
- The changed Policy takes effect when posted on this page. For important changes, such as changes to the information we handle or the purposes of use, we will give advance notice on this page or in the App, and obtain consent where required by law.
